La presente tesis surge del problema que presenta la falta de determinación del alcance de la responsabilidad patrimonial del Estado Plurinacional de Bolivia, lo cual conlleva la falta de su demanda ante las instancias judiciales reflejando una aparente impunidad de la actividad estatal ante los daños provocados a los derechos fundamentales de los particulares, tal extremo se debe a la insuficiente reglamentación de esta figura jurídica y a que las disposiciones jurídicas aplicables son dispersas. Entonce el objetivo fue determinar el alcance de la responsabilidad patrimonial del Estado Plurinacional de Bolivia por medio del análisis de las principales teorías al respecto, estableciendo fundamentos jurídicos, tipos y requisitos. Asimismo describiendo su contexto nacional e internacional y conociendo el entendimiento de los abogados bolivianos al respecto The present thesis arises from the problem that presents the lack of determination of the scope of the patrimonial responsibility of the Plurinational State of Bolivia, which entails the lack of its demand before the judicial instances reflecting an apparent impunity of the state activity before the damages caused to the Fundamental rights of individuals, this is due to the insufficient regulation of this legal entity as the applicable legal provisions are dispersed. Therefore, the objective was to determine the scope of the patrimonial responsibility of the Plurinational State of Bolivia through the analysis of the main theories in this respect, establishing legal foundations, types and requirements. Also describing its national and international context and knowing the understanding of the Bolivian lawyers in this regard
