El interés y preocupación de la presente tesis, versa sobre el control de Convencionalidad y los estándares de la Corte Interamericana de Derechos Humanos, sentencias de este órgano supranacional que plasmen el estándar más alto de protección de los derechos, que deberían ser de vital importancia en la aplicación o inaplicación de la Detención Preventiva contra el imputado, así mismo formar parte de la fundamentación, motivación e interpretación de derechos y que el juez penal, en su condición de autoridad judicial y garante del Control de Convencionalidad, genere mejores resoluciones, brinde mejor protección a los derechos y garantías del imputado y disminuya el riesgo de vulneración del debido proceso para los sujetos procesales, evitando actos arbitrarios y la emisión de condenas anticipadas The interest and concern of this thesis concerns the control of Conventionality and the standards of the Inter-American Court of Human Rights, judgments of this supranational body that embody the highest standard of protection of rights, which should be of vital importance in the application or inapplication of the Preventive Detention against the accused, as well as being part of the grounds, motivation and interpretation of rights and that the criminal judge, in his capacity as judicial authority and guarantor of Conventional Control, generate better resolutions, provide better protection of the rights and guarantees of the accused and reduce the risk of violation of due process for the procedural subjects, avoiding arbitrary acts and the issuance of early sentences
