En cuanto a la legislación comparada se llegó a establecer que la Corte Constitucional de Colombia fue entre algunas la que estableció que el derecho a la libertad de expresión no solo es un derecho fundamental sino el principio fundante y base de la sociedad democrática. Por otra parte, se tiene que la libertad de comunicación integrada por la libertad de información es considerada como especie concebida dentro de la libertad de expresión constituyéndose así como un derecho fundamental, cuyo ejercicio goza de protección jurídica y que a la vez implica obligaciones y responsabilidades que deben sustentarse bajo los principios de veracidad e imparcialidad, y bajo el derecho de rectificación ante el mal ejercicio de aquel derecho Regarding comparative legislation, it was established that the Constitutional Court of Colombia was among some that established that the right to freedom of expression is not only a fundamental right but also the founding principle and basis of democratic society.
