La jurisprudencia tiene por objeto garantizar la seguridad jurídica y la igualdad en la aplicación del derecho, consecuentemente se la considera como la correcta interpretación de la Ley y es, en la actualidad tomada como la interpretación del derecho plasmada en la emisión de los autos supremos.
Todas las instancias jurisdiccionales deben aplicarla como un criterio obligatorio, para dar respuesta a casos prácticos que se suscitan en el cotidiano acontecer judicial.
En cumplimiento de la Ley 025 del Órgano Judicial, el Tribunal Supremo de justicia como la máxima instancia de la jurisdicción ordinaria, a través de los "Resúmenes de jurisprudencia", pretende exponer la jurisprudencia relevante, generada en esta instancia judicial. The purpose of jurisprudence is to guarantee legal certainty and equality in the application of the right, consequently it is considered as the correct interpretation of the Law and is, at present, taken as the interpretation of the right embodied in the issuance of the supreme documents.
All jurisdictional instances must apply it as a mandatory criterion, to respond to practical cases that arise in the daily judicial events.
In compliance with Law 025 of the Judicial Organ, the Supreme Court of Justice as the highest instance of the ordinary jurisdiction, through the "Summaries of jurisprudence", intends to expose the relevant jurisprudence, generated in this judicial instance.
