Esta tesis esta dividida en tres capítulos, cada uno con una finalidad específica que hace de la investigación prolija y entendible cumpliendo con las formalidades y rigor científico de la Universidad Andina Simón Bolívar.
El primero es una reseña histórica de los antecedentes de la Justicia Restauratuva, el segundo es un compilado de doctrina referente a derechos, conceptos más doctrina de sobre el instituto jurídico de la justicia restaurativa y por supuesto un cuestionario de cada uno de ellos que lleva a la investigación a una confrontación de posturas sobre la problemática en cuestión y por último el marco contextual sobre el entorno que circunvala en cuanto a legislación y normativa comparada con otros países. This thesis is divided into three chapters, each with a specific purpose that makes the research neat and understandable by complying with the formalities and scientific rigor of the Universidad Andina Simón Bolívar.
The first is a historical review of the background of Restorative Justice, the second is a compilation of doctrine concerning rights, concepts plus doctrine about the legal institute of restorative justice and of course a questionnaire of each of them that leads to the investigation to a confrontation of positions on the problematic one in question and finally the contextual frame on the surroundings that circuvala as far as legislation and normative compared with other countries.
