El presente trabajo investigativo se centra en analizar la regulación jurídica de la cancelación de usufructo por muerte del usufructuario y su incidencia en la carga procesal de los tribunales de justicia que son parte de la jurisdicción ordinaria, para de forma posterior advertir la necesidad de reconocerla como una atribución de los Notarios de Fe Pública dentro de la vía voluntaria notarial, esto debido a que el rol que actualmente juegan los Notarios dentro de las relaciones jurídicas es activo y no pasivo, teniendo como efecto la descongestión del sistema judicial boliviano. This research work is focused on analyzing the legal regulation of the cancellation of usufruct due to the death of the usufructuary and its incidence on the procedural burden of the courts of justice that are part of the ordinary jurisdiction, in order to subsequently note the need to recognize it as an attribution of the Notaries of Public Faith within the voluntary notarial process, because the role currently played by Notaries within the legal relations is active and not passive, having as an effect the decongestion of the Bolivian judicial system.
