| Sumario, etc, | En el presente trabajo de investigación se estudió las disposiciones constitucionales sobre la revocatoria de mandato, contenidas en el artículo 240 parágrafo I que exime al Órgano Judicial de la revocatoria de mandato y del artículo 195 numeral 1, que atribuye al Consejo de la Magistratura del Tribunal Supremo de Justicia y del Tribunal Agroambiental, cuando en el ejercicio de sus funciones cometan faltas gravísimas, determinadas por ley, se realizó el estudio, porque en una interpretación literal de los mismos se identificó se identificó una contradicción de estos preceptos referente al tema "revocatoria de mandato", donde una norma prohíbe la revocatoria de mandato para el Órgano Judicial, sin embargo la otra disposición permite la misma; por tal razón se realizó una interpretación conforme al criterio interpretativo de la voluntad del constituyente (Art. 196. II), que a través de un proceso consolidó su voluntad en el proyecto de constitución aprobado en la ciudad de Oruro |

| Sumario, etc, | In the present work of investigation the constitutional dispositions on the revocation of mandate, contained in the article 240 paragraph I that exempts to the Judicial Organ of the revocation of mandate and the article 195 numeral 1, that attributes to the Council of the Magistrature of the Court, was studied. Supreme Court of Justice and the Agro-Environmental Court, when in the performance of their duties commit serious offenses, determined by law, the study was carried out, because a literal interpretation of them identified a contradiction of these precepts was identified with reference to the subject "Revocation of mandate ", where a norm prohibits the revocation of mandate for the Judicial Organ, however the other provision allows it; for this reason an interpretation was made according to the interpretative criterion of the will of the constituent (Art. 196. II), which through a process consolidated its will in the draft constitution approved in the city of Oruro |
