| Sumario, etc, | El presente trabajo a manera introductoria y contextual hace referencia a que a casi 200 años de ser un Estado libre y soberano, no podemos "liberarnos" por ser un Estado que, arrastra en su imaginario, en sus costumbres, formas de vida, etc. estructuras coloniales, dentro de estos por ejemplo, tenemos aún el monismo que ha prevalecido en nuestra realidad jurídica y política; sin embargo, haciendo un análisis más profundo de nuestra realidad, el monismo jurídico en nuestro país, no garantizó la cohesión y el carácter unitario de Bolivia, por el contrario, resguardó intereses de sectores con mejor posición económica y educativa, ignorando una basta realidad, como es la realidad indígena originaria campesina, es en correspondencia a esta realidad que entendimos la necesidad de reconocernos como un país con diversidad de culturas, que pervivieron a lo largo de nuestra historia y que reclaman que al fin se les reconozca formalmente, en fin, la necesidad de reconocernos tal como somos diversos dentro de un mismo país, logrando importantes avances, avances que tienen un punto de inflexión en la aprobación de la Constitución Política del Estado actual, la que reconoce y garantiza la aplicación y ejercicio de la Jurisdicción indígena Originaria y consagra el pluralismo jurídico en los siguientes artículos constitucionales: 1, 30.II, 179.II y 190.I |
