La venta con pacto de rescate constituye una figura jurídica por la que una persona propietaria de un bien inmueble o mueble, ejerce un derecho de libre disposición de sus bienes, reservándose mediante una cláusula expresa, la posibilidad de rescatar el bien transferido, en el término pactado por las partes, devolviendo el precio recibido, por parte del vendedor y el comprador devolviendo la cosa comprada. La característica de esta figura jurídica, es que no se estipula interés alguno, por el dinero que obtiene el vendedor. Esta figura jurídica evoca el consentimiento de los contratantes, por parte del vendedor de revertir la venta, para que vuelva a su poder el bien que transfirió, del comprador vuelva su poder de dinero que pago por la compra
