El presente trabajo titulado Legitimación activa en defensa de intereses difusos, surge como consecuencia de la lectura del Anteproyecto de Código del Proceso Civil, que dedica el articulo 45 al tratamiento de los intereses difusos. La introducción de esta figura nueva para nuestra estructura procesal civil vigente, constituye un avance muy importante dentro de la tendencia a brindar efectiva respuesta a las nuevas demandas sociales, porque refleja la comprensión cabal acerca de nuevos conflictos que actualmente no cuentan con una regulación procesal dentro de nuestra estructura legal, pero que requiere imperiosamente ser tenidos en cuenta
The present work entitled Legitimation active in defense of diffuse interests arises as a consequence of the reading of the Proposed Draft Code of Civil Procedure, which devotes Article 45 to the treatment of diffuse interests. The introduction of this new figure for our current civil procedural structure constitutes a very important advance in the tendency to provide effective response to the new social demands, because it reflects the complete understanding of new conflicts that currently do not have a procedural regulation within Of our legal structure, but which urgently needs to be taken into account
