A partir de la creación de la Convención sobre los Derechos del Niño, se estableció un sistema de responsabilidad penal juvenil, que permite el procesamiento de menores de edad bajo garantías especiales, buscando responsabilizar al menor por sus acciones pero al mismo tiempo priorizando su rehabilitación y tratando de ejercer el menor perjuicio posible por encontrarse sometido a un proceso penal. Este sistema penal se basa en tratados e instrumentos internacionales como las Reglas de Beijing y la convención sobre los Derechos del Niño, entre otros, que limitan y establecen las normas, principios y garantías que se deben aplicar al momento del procesar a un menor de edad
