El presente trabajo de investigación plantea la problemática del prevaricato en el nuevo constitucionalismo en Bolivia, para este efecto se aborda definiciones que sustentan que el juez es protagonista del Estado Constitucional, en cuya investidura recae el poder y el deber para ejecutar la constitución de forma progresiva, aplicando su contenido como guardián y garante efectivo de derechos y garantías constitucionales, dejando de ser legalista para actuar con libertad objetivada en la ley, la constitución y las normas del bloque de constitucionalidad
