En el presente trabajo me propongo intentar un acercamiento al tema del derecho fundamental al juez imparcial como fundamento del reconocimiento jurisdiccional de causas de excusa y recusación no contenidas expresamente en el código procesal civil en actual vigencia.
Para este cometido el trabajo se divide en tres partes, en la primera referida al sustento teórico, se realizó un análisis doctrinal y jurisprudencial (nacional y comparada) de temas referidos a la imparcialidad judicial como característica fundamental fundamental del proceso jurisdiccional; el derecho al juez imparcial como derecho fundamental; aspectos de la imparcialidad: objetiva y subjetiva

In this paper I intend to try to approach the issue of the fundamental right to the impartial judge as the basis for the judicial recognition of causes of excuse and challenge not expressly contained in the civil procedural code currently in force.
