En la investigación se examinan los fallos contra la sociedad a partir de un acercamiento a la realidad desde una perspectiva analítica de la aplicación de la presunción de constitucionalidad, la investigación se centra en aspectos de afectación clara respecto a la aplicación de norma basándose en el principio de aplicación de la norma y la seguridad jurídica.
El trabajo fruto de una revisión sistemática y metodológica o concibe la elaboración dogmática efectuada de espaldas a la realidad, el destacado desarrollo de los casos respecto a afectaciones en fallos jurídicos aporta datos fundamentales a la luz de los cuales deben analizarse la inconstitucionalidad de una norma

In the investigation we examine the judgments against society from an approach to reality from an analytical perspective of the application of the presumption of constitutionality, the research focuses on aspects of clear involvement with regard to the application of rule based on the principle of application of the rule and legal certainty.
The work that is the result of a systematic and methodological review or conceives the dogmatic elaboration carried out with backs to the reality, the outstanding development of the cases with regard to affectations in legal judgments provides fundamental data in the light of which the unconstitutionality of a norm must be analyzed
