El presente trabajo de investigación científica tiene su fundamento en el pensamiento inicial de la admisión de la prueba audiovisual dentro del proceso penal, sin que la producción de la misma constituya una vulneración gravísima al derecho a la intimidad y privacidad; pretende responder a la hipótesis planteada en el marco teórico de la existencia de la posibilidad de que el proceso de obtención e incorporación al juicio de la prueba audiovisual se desarrolle dentro del marco de constitucionalidad y con las debidas garantías ofrecidas por el bloque de constitucionalidad; para obtener esta hipótesis se ha realizado una investigación a través de la interpretación jurídica sistemática
