El proceso de investigación desarrollado en el presente trabajo, se basó en un análisis jurídico político de los derechos fundamentales y las garantías constitucionales de los privados de libertad en el marco de la nueva Constitución Política del Estado Plurinacional de Bolivia, mostrando los avances, las precisiones necesarias, así como las debilidades críticas que podrían ser subsanadas tanto en futuras reformas, como en el desarrollo legislativo posterior a la luz del paradigma denominado bloque de constitucionalidad.
