Habiéndose previsto la protección de los derechos a la privacidad, intimidad, honra, honor, propia imagen y dignidad de las personas en nuestra ley suprema y normas supra que conforman el bloque de convencionalidad, a fin de determinar la efectiva y material tutela de esos derechos con los fallos que emite el Tribunal Cosntitucional Plurinacional, se realizó un análisis de los antecedentes históricos sobre la tutela de los derechos a la privacidad desde el reconocimiento de los Derechos Humanos y la emisión de convenios que tutelan y garantizan en la norma el ejercicio efectivo de tal derecho, asimismo se revisó los antecedentes de la acción de protección de privacidad en el instituto del recurso de habeas data.
