Los derechos humanos son inherentes a la naturaleza misma del hombre. Con el paso del tiempo, se han ido reconociendo los derechos y éstos han sido clasificados en el ámbito del Derecho Internacional como de primera, segunda y tercera generación, por el orden de su reconocimiento. en el caso de Bolivia, la Constitución, tiene un diálogo de derechos reconocidos como fundamentales, quedando algunos derechos reconocidos por los tratados internacionales fuera de dicho catálogo, por lo que no consideramos necesario que el catálogo de derechos se amplíe pero si es fundamental la inclusión de un artículo que de el reconocimiento de derechos fundamentales Human rights are inherent in the very nature of man.
