<br/><br/> La falta de protección constitucional a las víctimas del delito y abuso del poder, genera desigualdad respecto al agresor que tiene garantías que lo protegen. Las normas infraconstitucionales no toman en cuenta los derechos y garantías de la víctima, porque no existen en la Constitución, si bien han previsto derechos y garantías para las personas lo hacen de forma general, es decir son diferenciar a las víctimas con un grupo de personas vulnerables por el delito y abuso del poder, que merece protección constitucional  The lack of constitutional protection to victims of crime and abuse of power, generates inequality in aggressor who has guarantees that protect it.
