Actualmente la asistencia post-penitenciaria o tratamiento carcelario (escasamente regulado en nuestra legislación nacional y muy poco tratado a nivel doctrinario) con el objeto de determinar si dicho tratamiento constituye sólo un acto de asistencia social proveniente del Estado o es un derecho constitucional y fundamental exigible. Al parecer el tratamiento carcelario no solo es una "asistencia social" sino que constituye también un derecho de naturaleza constitucional del liberado o excarcelado. Finalmente se propone efectuar reformas pertinentes para que la institución penitenciaria sea regulada de acuerdo al mandato constitucional y normas sustantivas de la Ejecución Penal. Currently the post-penitentiary assistance or prison treatment (scarcely regulated in our national legislation and very little treated at the doctrinal level) in order to determine whether such treatment is only an act of social assistance from the State or is a constitutional and fundamental right required . Apparently the prison treatment is not only a "social assistance" but also constitutes a constitutional right of the released or released. Finally, it is proposed to carry out relevant reforms so that the penitentiary institution is regulated according to the constitutional mandate and substantive norms of the Criminal Enforcement.
