<br/><br/> La presente investigación denominada: “La vulneración del derecho a la presunción de inocencia en la aplicación de la medida de protección de remoción del agresor de su medio laboral a denuncia de la víctima”, analiza si la facultad que se le otorga al Fiscal de Materia para remover al presunto agresor de su medio laboral en el que se desempeña, sin que medie un proceso administrativo y/o disciplinario respecto de una situación en concreto que permite aplicar este severo instituto ante sola denuncia por la presunta comisión del delito de acoso sexual, se constituye en una pena anticipada que vulnera el derecho de presunción de inocencia.  The present investigation called: &quot;The violation of the right to the presumption of innocence in the application of the protective measure of removal of the aggressor from his work environment upon complaint by the victim&quot;, analyzes whether the power granted to the Prosecutor of Matters to remove the alleged aggressor from the work environment in which he works, without the mediation of an administrative and/or disciplinary process with respect to a specific situation that allows the application of this severe institute upon only complaint for the alleged commission of the crime of sexual harassment, constitutes an anticipated punishment that violates the right to the presumption of innocence.
