La actual constitución Política del Estado, dispone en su Artículo 410, la jerarquía normativa que ordena su aplicación, consignando a los Tratados Internacionales , con rango inferior a la Carta Fundamental y superior a las leyes nacionales estatutos autonómicos, cartas orgánicas y el resto del legislación departamental. al mismo tiempo, el código Tributario Ley No. 2492 de 2 de agosto de 2003, establece en su artículo 5 que los convenios y Tratados Internacionales aprobados por el Poder Legislativo, actual Órgano Legislativo, tienen rango jerárquico superior al pre citado Código de las leyes, constituyendo fuente del Derecho Tributario. En el artículo 6 del mencionado Código Prevé, además, el principio de legalidad o reserva de Ley como pilar fundamental del orden jurídico tributario boliviano, disponiendo que solo la Ley puede: crear, modificar y suprimir atributos definir el hecho generador de la obligación tributaria, fijar la base imponible y alícuota o el límite máximo y mínimo de la misma
