En la presente obra se abordan tres temas constitucionales: El Proceso Constituyente, Referéndum por autonomías departamentales y Bases constitucionales del efecto vinculante de las resoluciones constitucionales. En el Proceso Constituyente se estudian los conceptos básicos referidos al Poder Constituyente, Ente convocante y la Asamblea Constituyente, entre otros institutos y mecanismos relacionados al proceso de creación de la Constitución. El aspecto novedoso es que se lo realiza desde una perspectiva estrictamente jurídica, que obliga a reconducir los criterios políticos sobre dichos temas y también a desmitificar creencias muy extendidas sobre el carácter omnicomprensivo, ilimitado y plenipotenciario de la Asamblea Constituyente.

In the present work, three constitutional issues are addressed: The Constituent Process, Referendum for departmental autonomies and Constitutional Bases of the binding effect of constitutional resolutions. In the Constituent Process, the basic concepts referred to the Constituent Power, Convener Entity and the Constituent Assembly are studied, among other institutes and mechanisms related to the creation process of the Constitution. The novel aspect is that it is carried out from a strictly legal perspective, which forces us to redirect the political criteria on these issues and also to demystify widely held beliefs about the all-encompassing, unlimited and plenipotentiary nature of the Constituent Assembly.
