Sabemos que dentro de la vida en sociedad las personas naturales o físicas y las colectivas o jurídicas, en procura de sus fines propios y sus relaciones, en algún instante comienzan a experimentar conflictos de relevancia jurídica los cuales tienden a entorpecer la armoniosa vida y paz, es ahí donde surge y se manifiesta el derecho, sometiéndose a conocimiento del órgano jurisdiccional, la solución del conflicto mediante una decisión: sentencia, empero, para arribar a ella se debe iniciar el proceso respectivo
