La nueva configuración que adopta Bolivia para su estructura de gobierno, a partir de la puesta en vigencia de la Nueva Constitución del Estado Plurinacional, manda que los anteriores Poderes del Estado, Ahora son Órganos del Estado, porque en la nueva Constitución, el pueblo, el soberano es quien detenta el poder es el titular del mismo, por lo que delega el ejercicio de ese poder a órganos del Estado, el ejecutivo, el legislativo, el judicial y el electoral. Ese cambio de esencia es lo que se trata en la presente tesis de derecho constitucional, porque es necesario dejar claros las diferencias que ahora rigen en Bolivia, para que se dejen de lado las antiguas usanzas y se tnga mayor conciencia sobre el nuevo funcionamiento del Órgano Judicial, que es el campo de acción de la presente tesis.
